Italy became a member of the Hague Apostille Convention on December 13, 1977, and the agreement officially took effect on February 11, 1978. This international treaty simplifies the authentication of public documents for use abroad.

An apostille is an official certification that verifies the authenticity of documents such as birth and marriage certificates, death records, court rulings, business documents, and notarized statements. It confirms both the validity of the signature and the authority of the official who issued the document.

Italian documents bearing a Hague apostille are legally recognized in over 120 countries that are part of the Hague Convention, eliminating the need for consular legalization. This significantly reduces the time, effort, and costs associated with document authentication.

For countries not part of the Hague Convention, an apostille alone is insufficient. Instead, consular legalization is required to validate the document for international use.

In Italy, different authorities handle apostille certification based on the document type:

  • Judicial documents, civil status records, and notarial acts → Certified by the Public Prosecutor’s Office at the court where the document was issued.
  • Administrative documents (e.g., registry office records, educational certificates) → Certified by the Prefect of the relevant territory.
    • Exceptions: In Valle d’Aosta, this authority is the President of the Region, while in Trento and Bolzano, it is the Government Commissioner.

The Public Prosecutor’s Office also manages the legalization of documents signed by notaries and court officials, while Prefectures handle records issued by local authorities and academic institutions.

Format of the Apostille in Italy

The apostille issued in Italy is a square stamp with a minimum side length of 9 cm. It includes the word “Apostille” in Italian, along with a mandatory reference to the Hague Convention in French (“Convention de La Haye du 5 octobre 1961“).
